RE: The tariff classification of a tea maker from Switzerland and China

Dear Ms. Diaz:

In your letter dated May 11, 2016, on behalf of your client Jura Inc., you requested a tariff classification ruling.

The merchandise is identified as the Capresso Iced Tea Maker, Model Number 624.02. It is an electrothermic domestic tea brewing machine. The machine includes an 80 ounces glass carafe with a removable lid and an easy pour spout. The machine can be used for brewing tea from loose tea or tea bags. It measures 13.5 inches tall by 6.25 inches wide by 9.75 inches deep. The machine in itself does not cool/ice the tea. That can be achieved by adding ice to the brewed tea in carafe.

The applicable subheading for Iced Tea Maker, Model Number 624.02 will be 8516.71.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other electrothermic appliances of a kind used for domestic purposes, coffee or tea makers. The rate of duty will be 3.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
